Judge Wallace Assigned to Scotland County Murder Case
A change of judge request has been granted in a Scotland County murder case, but the parties are still awaiting word on the change of venue motion presented by attorney Andrew Farwell on behalf of the defendant Michael J. Mutchler.
Mutchler, 22, of Memphis, was charged with class A felony murder in the first degree and felony armed criminal action following the shooting death of Joseph Alvey, 33, of Wyaconda on June 8, 2008.
Mutchler was arraigned on September 3, 2008 in front of First Circuit Judge Gary Dial at the Scotland County Courthouse, at which time he entered a plea of not guilty.
On September 9, 2008, a motion was filed by the defense requesting a change of judge and a change of venue.
On October 9th the court sustained the motion for a change of judge and notice was made by the circuit clerk to the Missouri Office of State Court Administrators (OSCA) requesting a judge be assigned to the case. According to the case docket, the parties agreed to the selection of Shelby County judge Gary Wallace.
Judge Wallace was officially assigned to the case on October 20th.
As of December 15th no decision had been announced on the change of venue request.
Mutchler remains in the custody of the Scotland County Sheriff’s Department. He is being held at an undisclosed area jail on a $1 million bond.
